Terms and Conditions

These terms are an agreement between you and [COMPANY LEGAL NAME] ("Eventinary", "we", "us") and they cover your use of eventinary.com and everything on it.

By creating an account, sending an invitation, listing yourself as a vendor, or replying to an invitation you have been sent, you accept these terms. If you do not accept them, do not use the service.

1. What Eventinary is

Eventinary is a tool for organising an event. You can design and send invitations by email and text message, collect replies, keep a guest list and a headcount, plan seating and tasks, publish updates to your guests, sell tickets to a public event, collect cash gifts, and find and book vendors.

Which of those you get depends on the kind of event you create. Not every feature applies to every event.

2. Your account

You need an account to host an event or to list yourself as a vendor. You are responsible for what happens under your account and for keeping your sign-in details to yourself.

You must be old enough to enter a contract where you live, and you must give us accurate details.

3. Your guests, and who is responsible for them

When you upload or type a guest list, that information is yours. You are responsible for it: for having a proper reason to hold those people's contact details, and for being entitled to send them an invitation. We process that information in order to run your event for you.

We will not sell your guest list, market to your guests on our own behalf, or use their details for anything other than delivering your event and the messages you ask us to send.

4. Guest links

Guests do not create accounts. Each guest receives a private link, and holding that link is what lets someone open and answer the invitation. Anyone who has the link can use it.

Treat those links as private. If you forward one, or post one publicly, you are giving whoever receives it the ability to reply as that guest. You can revoke a link at any time by removing the guest from your event.

An event can also have a single open invite link that anybody may reply through. That one is public by design.

5. Sending email and text messages

You may only send invitations, reminders and updates to people who would reasonably expect to hear from you about this event. You must not use Eventinary to send unsolicited bulk messages.

You are the sender. The message is yours, the list is yours, and you are responsible for complying with the marketing and anti-spam rules that apply where you and your guests are.

We may limit or stop sending on your behalf if we believe messages are unsolicited, if delivery complaints are high, or if continuing would put our own ability to deliver mail at risk.

6. Acceptable use

You must not use Eventinary to:

• break the law, or help anybody else do so
• send unsolicited bulk messages, or harvest contact details
• upload anything you do not have the right to use, including photographs and artwork
• upload anything obscene, hateful, harassing, or designed to deceive
• impersonate anybody, or run an event on somebody's behalf without their agreement
• attack, probe or overload the service, or work around its limits
• resell or rebrand the service without our written agreement

7. Your content

Anything you upload — designs, photographs, wording, guest lists — stays yours. You give us only the permission we need to store it, process it and show it to the people you are sending it to.

You confirm you have the rights to whatever you upload. If you use one of our built-in designs, you may use it for your own events; you may not resell it or pass it off as your own work.

We may remove content that breaks these terms.

8. Tickets and payments

Where an event sells tickets, payments are processed by Stripe and are subject to Stripe's own terms. Money for ticket sales is paid out to the host, not held by us as the seller.

The host — not Eventinary — is responsible for the event itself: for running it, for the accuracy of what is advertised, and for refunds. If an event is cancelled or changed, that is a matter between the host and the ticket holder.

9. Cash gifts

Where an event collects cash gifts, those payments are made by the guest to the host through Stripe. We are not a party to the gift and we do not hold the money.

A gift is a gift. It is not a ticket, it does not entitle the giver to anything, and it is not refundable by us.

10. The vendor marketplace

Vendors listed on Eventinary are independent businesses. We are not a party to any agreement between a host and a vendor, we do not employ them, and we do not guarantee their work, their pricing, their availability or their conduct.

An enquiry holds nothing. Only a booking a vendor has accepted takes a date off their calendar, and only the vendor can release it. Anything agreed beyond that — deposits, cancellation terms, what is actually delivered — is between the host and the vendor.

Vendors are responsible for the accuracy of their own profile, including their prices, the work shown in their portfolio, and the areas they say they cover. A vendor must have the right to publish every photograph on their profile.

11. Availability

We work to keep Eventinary running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features.

Where we plan work that will interrupt the service, we will give notice where it is reasonable to do so. We may take the service down without notice where security requires it.

12. Suspension and closing your account

You can stop using Eventinary at any time and delete your events. Deleting an event removes its guest list, replies, posts, tasks, seating and uploaded designs, and that cannot be undone.

We may suspend or close an account that breaks these terms, that is being used to send unsolicited messages, or where we are required to by law.

13. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, we are not liable for the running of your event, for a vendor's performance, for a guest's conduct, for messages a provider fails to deliver, or for loss of profit, goodwill or anticipated savings.

14. Changes to these terms

We may update these terms. Where a change materially affects you we will give notice before it takes effect, and the date at the top of this page always says when it last changed.

Continuing to use Eventinary after a change means you accept the updated terms.

15. Governing law

These terms are governed by the law of [JURISDICTION — e.g. England and Wales], and the courts of [JURISDICTION — e.g. England and Wales] have exclusive jurisdiction.
